Terms of Service

kapiche is a social prediction and reputation platform. Users create and join "pots" (friendly predictions), and the Service maintains reputation scores reflecting how accurately a user predicts ("Oracle Score") and how reliably a user settles real-money obligations to other users ("Settle Score").

The core public experience is free play. Every user receives free daily points, no purchase is ever necessary, and points have no cash value. Part of the public discovery feed is seeded from objective real-world questions that kapiche mirrors, read-only, from third-party prediction markets (currently Polymarket) so the feed always has fresh questions that resolve automatically from the third party's published outcome. kapiche is not the operator, market maker, or counterparty of those markets.

kapiche is software and a reputation service. kapiche is NOT:

• a bank, money services business, money transmitter, payment processor, or custodian;
• a gambling operator, sportsbook, casino, or betting exchange;
• a broker, dealer, exchange, investment adviser, or issuer of any security or token;
• an escrow agent, guarantor, or backstop for any obligation between users;
• the operator, market maker, or counterparty of Polymarket or any third-party market we mirror for discovery.

Points pots use a free, valueless in-app unit with no cash value. Real-money pots are private, friends-only arrangements that are settled directly between users off-platform; kapiche does not operate, bank, or take any cut of them.

(a) Points pots (free / public). Points are a free, sealed, valueless in-app unit. Every user receives free daily points and no purchase is ever necessary to play. Points cannot be purchased, sold, redeemed, exchanged, transferred, withdrawn, or converted to cash or anything of value, and carry no monetary value of any kind. Points exist only to score the game and rank reputation. kapiche takes no rake, cut, or fee from any points pot, and does not custody, hold, or route anything in a points pot. kapiche may grant, adjust, expire, or revoke points at any time. Nothing in the Service assigns points a dollar (or other currency) value, and points are never displayed as a dollar amount.

(b) Real-money pots (private / friends-only). Available only inside invite-only Circles among users who already know each other. Amounts are denominated in U.S. dollars. All money moves directly between users, peer-to-peer, off the platform, by wallet-to-wallet USDC transfer (onchain, on Solana) or via a third-party consumer payment app (for example Venmo, PayPal, Cash App). Real-money pots are not available to the public and not available among strangers.

(c) Mirrored markets (read-only discovery). Some public-feed questions are seeded from objective markets that kapiche mirrors, read-only, from a third-party prediction market (currently Polymarket, via its public Gamma API). On kapiche these appear as free points pots and resolve automatically from the third party's published outcome, with no human referee. kapiche does not place, match, route, hold, or take a cut of any order or position on Polymarket, is not Polymarket's agent or counterparty, and earns nothing from Polymarket activity. Any external market figures we display (for example Polymarket trading volume or prices) come from that third party, are shown in U.S. dollars and marked as Polymarket data, may be delayed or inaccurate, and are not kapiche's representation. Your participation on kapiche for these questions is in free points only.

kapiche never takes possession, custody, or control of user funds. kapiche does not hold, lock, escrow, freeze, reserve, pre-authorize, route, transmit, disburse, convert, or take any fee or cut from any money exchanged between users. kapiche does not maintain user balances of real money.

• When a real-money pot resolves, the Service records who owes whom and lets the parties settle directly with each other.
• For crypto settlements, you sign and send the transfer from your own wallet to the other user's wallet. kapiche may sponsor the network (gas) fee of a transfer you initiate and sign; doing so gives kapiche no ownership, custody, or spending authority over your funds.
• For fiat settlements, you pay the other user inside your own third-party payment app under that provider's terms. kapiche never sees, holds, or routes those funds and is not a party to that payment.
• Proof-of-funds is read-only. If you choose, the Service may display that your public wallet balance is sufficient to cover a pot. This is a read of public blockchain data only. It is not a hold, lock, escrow, or reservation; your funds remain entirely in your control at all times.

• The Service only observes and records settlement; it does not adjudicate, enforce, or guarantee it. A pot's referee/judge calls the outcome of the prediction (or, for mirrored markets, the outcome resolves automatically from the third party's published result); this is separate from settlement, which merely records that money changed hands.
• Verified (crypto): the Service reads the public blockchain to confirm a transfer between the parties' wallets and marks the obligation settled.
• Confirmed (fiat): the paying user marks payment sent and the receiving user confirms receipt (mutual attestation).
• Reputation scores are automated, informational signals derived from this activity. They are opinions/representations of past behavior, not guarantees of any user's future conduct, accuracy, solvency, or willingness or ability to pay. They are non-financial signals and confer no monetary value. You rely on them at your own risk. kapiche does not guarantee their accuracy and is not liable for decisions you make based on them.
• Disputes between users are between those users. kapiche may mark an obligation "disputed" or "voided" for reputation purposes but does not decide who is right, recover funds, or compel payment. Enforcement of any real-money obligation is solely between the users involved.

• You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service, and at least 18 to use any real-money feature.
• Real-money features are geographically restricted. Real-money pots and settlement features are not available to users located in: Utah (UT), Washington (WA), Hawaii (HI), Idaho (ID), Louisiana (LA), Tennessee (TN), Oklahoma (OK), and Nevada (NV), and may be further restricted by other jurisdictions where such activity is unlawful. We may block, geofence, or disable real-money features based on your location.
• You are responsible for ensuring your use, including any real-money arrangement with friends, is lawful where you are located. You must not use the Service where it is prohibited.
• No circumvention. You must not use a VPN, proxy, Tor, GPS spoofing, or any other tool or method to disguise or misrepresent your location, age, or identity, or to access real-money features from a restricted jurisdiction or while underage. Doing so is a material breach of these Terms and may result in suspension or termination of your account and loss of access.
• Points pots may be available more broadly because points have no cash value.

By using real-money features you acknowledge and accept that:

• Total loss is possible. Real-money pots are at-risk arrangements among friends; you can lose the full amount you put at risk.
• No insurance / no protection. Funds and transfers are NOT FDIC-insured, NOT SIPC-protected, and not insured or guaranteed by kapiche or any government agency. kapiche provides no protection, reimbursement, chargeback, or recovery of any kind.
• Crypto transfers are irreversible. Blockchain transactions generally cannot be reversed, cancelled, or refunded. You are responsible for sending the correct amount to the correct address.
• Counterparty risk is yours. The other user may fail or refuse to pay. kapiche does not guarantee payment and will not cover, advance, or recover it. Reputation scores are the only "enforcement," and they are informational.
• Third-party rails. Wallets, payment apps, on-ramps, and mirrored market data sources are operated by third parties under their own terms; kapiche is not responsible for them.
• No financial/tax/legal advice. You are responsible for any taxes arising from your activity.

You agree not to: use the Service for unlawful gambling, money laundering, or fraud; create real-money pots open to the public or to strangers; misrepresent outcomes, payments, or identities; manipulate or collude to inflate reputation; offer cash or anything of value for points; or attempt to buy, sell, or transfer points. We may suspend or terminate accounts that violate these Terms.

Authentication, wallets, payments, on-ramps, and mirrored market data may be provided by third parties (for example Privy, the Solana network, Venmo, PayPal, and Cash App, our on-ramp provider, and Polymarket for read-only market data). Your use of those services is governed by their terms; kapiche is not responsible for them.

• Pro is an optional $5/month subscription that unlocks software features (for example unlimited real-money pots, advanced analytics, larger Circles). Pro is a fee for software features only: it is never a charge on, share of, or condition of any pot or prediction. Pro is $5 in USDC per month, paid through our non-custodial payment provider, and auto-renews monthly from your own wallet until you cancel. You can cancel anytime and keep Pro through the end of the current billing period. Fees are non-refundable except where required by law.
• Cosmetics (avatars, themes, flair, badges) are direct-purchase digital items with no cash value, non-refundable except as required by law, and not tradeable or redeemable for value.
• No fee is ever charged as a percentage of, or deducted from, any pot or transfer between users.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. KAPICHE IS NOT LIABLE FOR ANY LOSS ARISING FROM USER-TO-USER ARRANGEMENTS, FAILURE OF ANY USER TO PAY, THIRD-PARTY SERVICES (INCLUDING MIRRORED MARKET DATA), REPUTATION SCORES, OR YOUR USE OF REAL-MONEY OR CRYPTO FEATURES. To the maximum extent permitted by law, kapiche’s total liability for any claim relating to the Service is limited to the greater of the total amounts you paid kapiche in the twelve months before the claim or USD 100, and kapiche is not liable for indirect, incidental, special, consequential, or punitive damages. You agree to indemnify kapiche for claims arising from your use or your arrangements with other users.

We may update these Terms; material changes will be notified by posting the updated Terms here and, where appropriate, by email or in-app notice. Governing law: the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally is resolved by binding individual arbitration seated in Sheridan, Wyoming, and you and kapiche each waive any class action or jury trial, to the fullest extent permitted by law.
